Terms and Conditions for SaaS Services
CHAPTER I. INTRODUCTION
Failure to comply with the provisions of these Terms and Conditions for using WebDisk Cloud Computing SaaS services will result in immediate suspension or termination of the SaaS Service (hereinafter referred to as "Service"), in accordance with the applicable conditions for its delivery. CHAPTER II. VIOLATION OF PROVISIONS
- It is prohibited to use WebDisk networks and services for the purpose of causing and/or promoting illegal, offensive or irresponsible behavior, such as:
1.1. unauthorized access to or use of data, systems or networks, including any attempt to probe, examine or test system or network vulnerabilities or to breach security measures or authentication methods without the express consent of the system or network owner;
1.2 engaging in activities that cause interference with the use of the service for any of its users, including, as one of many examples, attacks using pirated software, cracks, key generators, serials, cyber attacks of any kind, including DOS attacks, viruses and other destructive elements, or deliberate attempts to overload the transmission system;
1.3. collecting and/or using email addresses, names or other identifying data without the consent of the interested party (including, without limitation, spamming, phishing, internet fraud, password theft, spidering);
1.4. collecting and/or using information concerning third parties without obtaining the permission of their owner;
1.5. Use and/or distribution of any false, misleading, or unreliable information, as one of many examples but not limited to, via email or discussion groups;
1.6. Use of the service to distribute software that covertly collects user information or covertly transmits information about the user;
1.7. Use of the service to distribute software known as "adware", excluding cases where:
1.7.1. The user has obtained explicit consent to download and install the software based on a clear and conspicuously displayed notice regarding the type of software;
1.7.2. The software is easily removable using standard removal tools, including major operating systems (for example, Microsoft "Add/Remove Programs");
CHAPTER III. USE OF SYSTEM RESOURCES
- The User may not use the service in a manner that disrupts the normal operation of WebDisk services. In such a situation, Mazura Sp. Z o.o. may request restoration to normal operation levels, in cases where such improper use disrupts, in its sole discretion, the use of the service by other users.
- The User undertakes not to use defective or non-homologated equipment, in accordance with European standards, or equipment with defects that could damage network integrity and/or disrupt the Service and/or pose a risk to the physical safety of individuals. Mazura Sp. Z o.o. provides no warranty regarding the compatibility of devices and software (hardware and software) used by the Client when using the Service; appropriate controls of this nature remain the exclusive responsibility of the Client.
CHAPTER IV. PENETRATION TESTING
The user cannot in any way examine, test, or penetrate the vulnerabilities of the WebDisk system and network or compromise the security of Mazura sp. z o.o. and the applicable authentication procedures, whether using passive or invasive techniques, without explicit written permission from Mazura sp. z o.o., nor, consequently, undertake the aforementioned activities using services provided by WebDisk related to networks and/or information concerning third parties without their explicit permission.
CHAPTER V. DISCUSSION GROUPS, FORUMS, AND OTHER NETWORKS
The Client acknowledges and accepts that the content of commercial messages, messages in any online announcements, group chats, or any other type of forum in which they participate (as one of many examples), IRC and discussion groups, is subject to the applicable law and respective regulations in this regard. They must also comply with the rules of any other network to which they have access or which they use through WebDisk services.
CHAPTER VI. OFFENSIVE CONTENT
- The publication, transmission, and storage on the network, or through WebDisk equipment, of any content or links containing content that Mazura Sp. Z o.o. objectively deems to be the following is prohibited:
1.1. establishing, presenting, promoting, supporting, or referring in any way to pedophilia, racism, fanaticism, or containing pornographic content, in violation of applicable law in this matter and permitted only for adults;
1.2. excessively brutal, inciting violence, containing threats, content regarding harassment, or expressing hatred;
1.3. unethical or misleading with respect to consumer protection regulations of any country, including chain letters or pyramid schemes;
1.4. offensive or violating the privacy of individuals;
1.5. posing a risk to the safety of individuals and health, risk to public safety or public health, threatening national security or disrupting investigations conducted by appropriate authorities;
1.6. improperly disclosing trade secrets, confidential information, or information belonging to third parties;
1.7 actions intended to help third parties circumvent copyright law;
1.8. infringement of third-party copyrights, trademarks, patents, or other rights belonging to third parties;
1.9. promoting narcotics, violating export control laws, illegal gambling, and illegal arms trafficking;
1.10. other illegal activities or incitement to illegal conduct, in violation of applicable law, relevant jurisdiction, customer agreement, or Mazura sp. z o.o.;
1.11 other harmful conduct, fraud, which may result in legal proceedings against Mazura sp. z o.o..
- Content "published and transmitted" via Mazura sp. z o.o. networks or infrastructure shall include content contained on web pages, in email messages, chats, and any other content published or transmitted via the Internet.
CHAPTER VII. MATERIAL PROTECTED BY COPYRIGHT
- Use of Mazura Sp. Z o.o. networks is prohibited for downloading, publishing, distributing, copying, or using in any manner texts, music, software, artwork, images, and other content protected by copyright, except in situations where:
1.1 the owner of the relevant rights has given explicit authorization;
1.2 applicable copyright law in the relevant jurisdiction permits their use.
CHAPTER VIII. FINAL PROVISIONS
- The Client agrees to provide Mazura sp. z o.o. with their personal data, necessary for the full and proper performance of the contract; the Client also guarantees, on their own, exclusive, and personal responsibility, that the provided data are correct, current, and true, and allow for the identification of their true identity.
- The Client agrees to immediately notify Mazura sp. z o.o. of any changes to the provided data, within a period not exceeding 15 (fifteen) days from the occurrence of such changes, and also to provide, at any moment, upon request of Mazura sp. z o.o., an appropriate document confirming their identity, place of residence or registration, and, if necessary, proof of performing the function of a representative of a legal entity that is the applicant or in possession of the service.
- Upon receiving the information described above, Mazura sp. z o.o. has the right to require from the Client additional documentation confirming the notified changes. In the event that the Client fails to provide Mazura sp. z o.o. with the aforementioned information, or required documentation, or in the case of providing Mazura sp. z o.o. with false, outdated, or incomplete data, or data that Mazura sp. z o.o. has reasons, in accordance with its own unquestionable opinion, to consider as such, Mazura sp. z o.o. reserves the right to:
3.1 reject the request submitted by the Client concerning activities to be performed under the provided service;
3.2 immediately suspend the service, without notice and for an indefinite period;
3.3 cancel and/or terminate without notice any activities modifying
data assigned to the Service;
3.4 withdraw from the Contract.
- The Client accepts that if public IP addresses assigned to their account are placed on blacklists of addresses (databases concerning abuse), such as those on spamhaus.org, and this results in automatic violation of the terms of this agreement, Mazura sp. z o.o. may take any measures deemed appropriate to protect its own IP addresses, including suspension and/or termination of service, regardless of whether the IP blacklisting was caused by Client fault;
- The Client agrees that data stored in the shared system may be quarantined or deleted if it is infected by viruses or otherwise corrupted, or according to the indisputable opinion of Mazura sp. z o.o., may potentially infect or damage the system or data of other clients hosted on the same infrastructure.
- The Client commits to adhering to standards of appropriate use of network resources, commonly referred to as "Netiquette".
CHAPTER IX. SLA
Compensation provided by the "Guaranteed Service Level" - "Service Level"
WebDisk Cloud Computing Agreement does not apply in case of service interruptions
services resulting from the violation of this terms and conditions.
